Biography

Joe Magliolo is a trial lawyer and former federal prosecutor with extensive experience handling significant cases and investigations involving cybercrime, False Claims Act-based allegations, export-control and economic-sanction laws, and national security issues. In his practice, Joe advises businesses and individuals under criminal or civil investigation by the government and conducts internal investigations for public and private companies seeking an independent view into their most complex problems. He also represents clients in civil disputes at the pre-trial, trial, and appellate levels in state and federal court.

Prior to Jackson Walker, Joe served as an Assistant U.S. Attorney for the Northern District of Texas and was the district’s Lead Computer Hacking and IP (CHIP) Attorney. In that role, he investigated and prosecuted numerous high-profile cases involving violations of U.S. economic sanctions laws, cybercrime and dark-web-based crime, terrorism, wire and mail fraud, and money-laundering offenses. Joe is an experienced trial lawyer who has tried many cases to verdict or successful resolution in state and federal courts. He also held TS/SCI clearances, developed and managed the Northern District’s crisis-response plans, and was named among a select number of federal prosecutors nationwide to serve on the Department of Justice’s Disruptive Technology Strike Force. As a federal prosecutor, Joe also authored over 70 appellate briefs and presented 13 oral arguments before the United States Court of Appeals for the Fifth Circuit on a variety of complex criminal matters.

Joe previously served as a clerk for the Honorable Leslie H. Southwick of the United States Court of Appeals for the Fifth Circuit Court and practiced litigation at two prominent law firms. His work included defending major public companies during significant antitrust and FCPA investigations and representing clients in federal and state courts on matters related to the Civil Rights Act and the Americans with Disabilities Act.

Before practicing law, Joe interned for the Office of Former President George H.W. Bush and was an on-air sports radio co-host and contributor for Sportsradio 1310 The Ticket and 105.3 The Fan.

Prosecutor Experience

  • Served as lead prosecutor on hundreds of cases and investigations involving violations of United States economic-sanctions laws, cybercrime and dark-web-based crime, international and domestic terrorism, wire and mail fraud, securities fraud, healthcare fraud, and money-laundering offenses, among many others.
  • Acted as lead or co-lead prosecutor on five successful jury trials involving the dark web, bitcoin, immigration, controlled-substance, conspiracy, and robbery charges.
  • Prepared approximately 70 briefs and presented oral argument 13 times before the Fifth Circuit Court of Appeals on criminal and civil issues involving the dark web, money laundering, the Fourth Amendment, criminal restitution payments, sufficiency of the evidence on multiple jury trials, and others.
  • As Crisis Management Coordinator for the Northern District of Texas, developed crisis response plan and served as onsite coordinator during crises, including the 2022 Colleyville Synagogue hostage situation.
  • Was named one of small number of AUSAs nationwide on the DOJ’s Disruptive Technology Strike Force, responsible for protecting America’s critical technological assets from being used by foreign adversaries through enforcement of export-control laws.
  • As the District’s Digital Asset Coordinator, acted as a subject-matter expert on criminal uses of digital assets.
  • Successfully obtained plaintiff-side summary judgment in favor of the government in seven-figure civil dispute in federal court.

Private Practice

  • Represented major Japanese automotive parts manufacturer before Department of Justice relating to significant antitrust investigation, involving allegations of price-fixing; participated in SEC and Department of Justice FCPA investigation of public company relating to bribery allegations.
  • Represented clients before state and federal trial and appellate courts in matters involving alleged violations of the Civil Rights Act, the Americans with Disabilities Act, and related federal and state statutes.
  • Served as co-lead counsel in Dallas County jury trial, resulting in successful settlement.

Cases and Investigations include:

  • (N.D. Tex.) Served as lead counsel in complex jury trial involving use of the dark web to launder monetary proceeds of drug sales and related cybercrimes. Obtained guilty verdicts.
  • (N.D. Tex.) Served as co-lead counsel in jury trial involving complex robbery conspiracy. Obtained guilty verdict on all counts.
  • (N.D. Tex.) Served as lead prosecutor into export-control issues involving significant domestic company.
  • (N.D. Tex.) Served as lead counsel for plaintiff in property dispute over approximately $1 million in real property, resulting in successful summary judgment in favor of client.
  • (N.D. Tex.) Served as lead prosecutor in multiple cyber-intrusion cases into public and private companies.
  • (5th Cir.) Represented the United States on appeal after a doctor and multiple pharmacists were convicted for their management of complex pill-mill operation. The Fifth Circuit affirmed in a published opinion containing helpful precedent for the government on evidentiary and mental-state issues.
  • (5th Cir.) Represented the United States on appeal after defendant convicted of multiple fraud convictions following a complex trial. The Fifth Circuit affirmed the convictions.
  • (5th Cir.) Represented the United States on appeal in joint civil and criminal interlocutory challenge to government’s seizure of approximately $20 million of property. The Fifth Circuit affirmed the government’s seizure in a published opinion.

  • Received the 2023 Superior Performance Award from the United States Attorney’s Office for the Northern District of Texas.
