Jackson Walker attorney Brandon Durrett will present at The Foundation for Natural Resources and Energy Law’s 69th Annual Institute in Salt Lake City, Utah, on July 21, 2023.
The program, “Turn Around, Don’t Drown – Oil and Gas Lease ‘Washouts’ and How to Avoid Them,” will discuss recent Texas cases and legislation that have expanded the jurisprudence relating to oil and gas lease “washout” transactions, including a new cause of action for bad faith washout of overriding royalties, the treatment of top leases under extension and renewal clauses, the risk of washout for owners of non-participating non-operators, and new applications of the rule against perpetuities to anti-washout clauses. Finally, the presentation will provide a multi-state comparison of legal treatment of washouts and practical advice to industry stakeholders on how to protect against washouts.
Brandon is a board-certified oil and gas attorney focused on acquisitions and dispositions, commercial industry agreements, and complex disputes over upstream and midstream oil and gas assets. Licensed to practice in Texas and New Mexico, he regularly speaks on topics such as oil and gas deals, disputes, and cases.
