He emphasized that the judge’s decision to allow the case to proceed should not be interpreted as an indication of a likely win for the plaintiff, Sydney Nicole. Instead, Marc believes that the judge is exercising caution, particularly given the novel nature of the case, and is refraining from making definitive rulings on several issues of first impression.
Marc noted, “I think that this is basically a case that has been deemed plausible enough to make it into discovery, but I think that’s a long way from having claims that are going to end up prevailing.”
