He offers experienced service to clients, and collaborating closely to better understand business goals and interests in order to develop and capitalize on each asset within their overall portfolio. He prepares and prosecutes all types of patent applications, as well as provides infringement/non-infringement, patentability, and freedom to operate assessments and opinions.
In keeping with the objective of maximizing business value for clients, Cline is devoted to growing the net worth of clients by maximizing actual and potential returns on intangible assets, such as their trademarks. Often, a business’ value is closely linked with the goodwill evoked in its customers’ minds by its familiar trademarks. Cline prepares and prosecutes domestic and foreign trademark applications; pursues oppositions, cancellations, and enforcement litigation; as well as provides related assessment opinions – working to establish a strong portfolio for the benefit of the client.
Cline draws upon years of legal, courtroom, and practical experience in the protection and enforcement of all types of intellectual property including filing copyright applications and helping clients monetize their copyrighted materials.
When statutory IP protection is not adequate or inappropriate, Cline will help establish trade secret programs and enforce trade secrets against their illegitimate use.
Negotiating and drafting various types of licenses and other IP agreements for the commercialization of proprietary rights and technologies. And, because maximizing asset values can mean determining with precision the extent of those assets, Cline conducts IP audits and due diligence reviews of IP portfolios for clients.
Unfortunately, the nature of IP rights can sometimes lead to conflict. Cline approaches the possibility of clients entering into litigation with their business interests in mind. The most advantageous litigation result can often be finding a way to stay out of the courtroom, and if it is in the client’s best interests, he seek to do just that. However, if litigation appears to be the best action or is unavoidable, his litigation experience allows him to vigorously represent clients in an aggressive and ethical manner.
